1. Acceptance of Terms

By accessing and using SpendTracker ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, you must not use our Service.

2. Description of Service

SpendTracker provides a subscription tracking and management platform that helps users:

  • Track and manage recurring subscriptions
  • Analyze spending patterns
  • Scan Gmail for subscription emails (with explicit consent)
  • Receive AI-powered insights and recommendations

3. User Accounts

Registration

To use certain features of our Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain and update your information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

Trial Period

New users receive a 3-day free trial. After the trial period, continued access requires a paid subscription.

4. Subscription and Payment

Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed through Stripe
  • You authorize us to charge your payment method on a recurring basis

Refunds

We offer a 30-day money-back guarantee for first-time subscribers. After this period, no refunds are provided for partial months.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service
  • Transmit viruses or malicious code
  • Use automated systems or software to extract data
  • Impersonate another person or entity
  • Share your account with others
  • Reverse engineer or decompile any part of the Service

6. Gmail Integration

Our Gmail integration is subject to Google's Limited Use requirements:

  • We only access emails to identify subscription-related messages
  • We don't sell, share, or transfer Gmail data to third parties
  • We don't use Gmail data for advertising
  • We only retain minimal subscription information extracted from emails
  • You can revoke Gmail access at any time

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SpendTracker and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the data you input into the Service.

8. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

9. Disclaimers

The Service is provided "as is" and "as available" without any warranties, expressed or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of information

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, SpendTracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill
  • Service interruptions
  • Computer damage or system failure
  • Cost of substitute services

Our total liability shall not exceed the amount paid by you in the past twelve months.

11. Indemnification

You agree to defend, indemnify, and hold harmless SpendTracker and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Request by law enforcement or government agency
  • Extended periods of inactivity
  • Fraudulent or illegal activity
  • Non-payment of fees

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the federal and state courts located in the United States.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and SpendTracker regarding the use of the Service, superseding any prior agreements.
